By accessing and using Nekafue's photography and videography services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you and Nekafue. If you do not agree with any part of these terms, you must discontinue use of our services immediately.

These terms apply to all users, clients, and visitors of our services, including but not limited to event organizers, individuals, corporations, and third-party representatives acting on behalf of clients.

2. User Obligations

As a user of Nekafue's services, you agree to:

• Provide accurate and complete information regarding event details, venue locations, and specific requirements
• Ensure all necessary permissions and releases are obtained from event participants for photography and videography
• Respect our photographers' and videographers' professional conduct and creative process
• Make timely payments according to agreed terms and schedules
• Provide safe and accessible working conditions at event venues
• Communicate any changes to event details at least 48 hours in advance when possible
• Respect intellectual property rights and usage restrictions on delivered content

Failure to meet these obligations may result in service modifications, additional charges, or contract termination at Nekafue's discretion.

3. Service Limitations

Nekafue's photography and videography services are subject to certain limitations and conditions:

• Services are provided based on availability and booking confirmation
• Weather conditions, venue restrictions, and unforeseen circumstances may affect service delivery
• Equipment failure, while rare, may impact certain aspects of coverage
• Final deliverables are subject to our standard editing and post-production processes
• Delivery timelines are estimates and may vary based on project complexity and seasonal demand
• Additional services beyond the agreed scope may incur extra charges

We strive to provide exceptional service quality while acknowledging that certain factors beyond our control may influence final outcomes.

4. Intellectual Property Rights

All photographs, videos, and creative content produced by Nekafue remain our intellectual property unless explicitly transferred through written agreement. This includes but is not limited to:

• Copyright ownership of all original creative works
• Rights to use images for portfolio, marketing, and promotional purposes
• Authority to determine usage permissions and licensing terms
• Protection against unauthorized reproduction, distribution, or modification

Clients receive usage rights for personal or agreed commercial purposes as specified in individual contracts. Any unauthorized use, reproduction, or distribution of our creative content may result in legal action and financial penalties.

5. Liability Limitations

Nekafue's liability is limited to the total amount paid for services rendered. We shall not be liable for:

• Indirect, consequential, or incidental damages arising from service use
• Loss of profits, business opportunities, or reputation
• Damages resulting from venue restrictions, weather conditions, or third-party actions
• Technical failures beyond our reasonable control
• Delays in delivery due to circumstances outside our direct influence

Our professional insurance covers equipment and general liability, but clients are encouraged to maintain their own event insurance for comprehensive protection.

6. Payment Terms and Cancellation Policy

Payment terms are established in individual service agreements and typically include deposit requirements and final payment schedules. Cancellation policies vary based on notice period and may include partial fee retention to cover preparation costs and lost booking opportunities.

Late payments may incur additional charges, and significant delays may affect delivery schedules or result in service suspension until accounts are current.

7. Dispute Resolution

Any disputes arising from these terms or our services shall be resolved through the following process:

• Initial good-faith negotiation between parties
• Mediation through mutually agreed neutral third party if direct negotiation fails
• Binding arbitration as final resolution method if mediation is unsuccessful

All dispute resolution proceedings shall be conducted in accordance with applicable local laws and regulations. Legal fees and costs may be awarded to the prevailing party at the arbitrator's discretion.

8. Privacy and Data Protection

We respect client privacy and maintain confidentiality of personal information shared during service provision. Event content may be used for portfolio purposes unless specifically restricted by client agreement. We implement reasonable security measures to protect stored data and client information from unauthorized access or disclosure.

9. Modifications and Updates

These Terms and Conditions may be updated periodically to reflect changes in our services, legal requirements, or business practices. Significant changes will be communicated to existing clients, and continued use of our services constitutes acceptance of updated terms.

Individual service contracts may contain specific terms that supplement or modify these general conditions for particular engagements.
